There are a number of state-specific forms you may need when going through the probate process.

General NY Forms

In New York, there is no filing deadline, and your estate's local Surrogate's Court, a New York City Surrogate's Court or county Surrogate's Court outside New York City, handles wills and estate proceedings (including probate).

You can check with your local court for the forms they might prefer, and below you will find some of the more common NY forms:

  1. Petition for Probate - Get the estate settlement process started (also includes Notice of Probate, and Affidavits of Having Provided Notice)
  2. Petition for Administration - Get the estate settlement process started if there is no will
  3. Probate Proceeding Checklist - Help for filling out the Petition for Probate
  4. Inventory of Assets - Tell the court about the contents of the estate
  5. Final Accounting Checklist - Prepare to petition for settlement
  6. Accounting Forms - Petition for settlement ... but you may be able to use a simplified approach
  7. Heir Receipt and Release (Form JA-2) - Have the heir confirm receipt of distribution

If you do not have an attorney, you may be able to file your papers electronically.
